Yes; he was out of status from March 2003. However; he had a valid I-94 card until February 2004. He didn't have a valid I-94 from February 2004 until april 2004.
once;he left and re-entered then the out of status time was finished. Since he didn't overstay his I-94 card by more then 180 days then he is not subject to the 3 year bar.
If his I-94 card expired in March 2003 then he would have had unlawful presence from that date forward and since it was more then one year then he would have been subject to 10 year bar.

Can someone advice on this.
Currently I am on H1B visa and I will apply my AOS before 17th august as dependent(Secondary applicant).
After applying AOS if I have to leave my job then will I be out of status since I won't be on H1 status and I won't be on H4 ?
Can I leave my job after applying AOS or I have to wait till We get receipts of 485?

After applying for I-485 you are in AoS Pending status and you can leave the current job without being out of status.
You should probably wait until I-485 is delivered.

After applying for I-485 you are in AoS Pending status and you can leave the current job without being out of status.
You should probably wait until I-485 is delivered.

I have a similar problem. In all my documents i just have one name as given name from childhood no surname or initials.
In passport given name is : XXX
And surname is : blank
In my H4 stamping they made it
Given name : FNU (First name unknow)
Last Name : XXX
So in my medical record and I-94, I-797 in US i use FNU XXX. I am planning to apply with this name itself as i feel it may take a while and is not safe to go to indain embassy and have a name change with this short time.
I plan to have my husbands name as my last name later.
Can i do it after filing for 485 or getting GC. Do reply.

Hi All,
I recently had my last name added on my Passport. I just submitted for updating the SSN. Couple of questions:
1. Does anybody know if I need to run the payroll and also file the taxes with new name on the SSN once it's been updated. I still need to file my 2009 taxes.
2. Do I need to inform USCIS about this or it should be OK if I just submit the new name on I-129 when I apply for renewal later this year.
3. I maintain H1B expiring Sept 2010. I might need to travel to India before expiration with the current visa. Do I need to do anything to avoid name confusion at POE?
Please share your experience. Appreciate your time.

North American naming conventions are clear, it has two essential parts, First Name and Last Name. Third part, the middle name is optional, and is also insisted upon, if you have one, to be written in full on all legal docs, such as PP, SS card etc.
Addition of something to your name probably is not adding your last name. It is rather changing your last name, legally speaking.
Therefore, this perhaps needs to be treated as a change of name, and you might need necessary legal docs to prove that, while trying to change for your taxes or other legal docs. Merely having a new passport with something added to your name, may or may not work.

ALLOW EVERYONE TO FILE I485 SHOULD BE OUR NUMBER ONE PRIORITY.
You people already have filed 485 and have EAD. EAD gives you so much freedom . It is as good as a green card.
What about people who are less fortunate and cannot file II485. We need to allow everyone to be on the same page first and enjoy EAD freedom.
That should be our priority before any country limits or this thread action item
Everybody waited for a fair time before they got there EAD's. None of us got the EAD on day one. So don't try to mix all the issues into one.
I support this initivative.

However, we are still in August and have yet to reach the September 2008 Visa Bulletin which was released by the State Department assumedly after consulting with the USCIS, and there is absolutely no evidence at this point that the FY 2008 EB-2 visa numbers have already been exhausted. People should calm down, keep patience, and wait for the agencies' announcements, if any.

Socio-Economic Osmosis == When you have a developed/super rich country across the borders with opportunities which do not exist in your homeland, people tend to move from one area to the other.

My I-485 was recieved on 7/3/07.
140 was approved 6/2006 by TSC. See a LUD on 7/28/07.
My 485 was sent to NSC.
Still waiting for reciepts/cashed checks.

Our forefathers travelled to the promised land in ships that were full of rats, without food or water. Several of them died while trying to reach here.
Once here on the promised land, we had to fight our way to create a free society that you are dying to be part of. America is land of entrepreneurs.
And any one that don't have an entrepreneurial spirit is not welcomed here.
What do you have to bring to the table?
So are we putting up with all the biased folks like you. We go to work everyday and earn our pay. We are not a burden to US. We contribute to the economy. We start about 25% of the companies. I can go on and on.
My question first though to the mods is why is this guy and his IP not banned?

Good idea and will atleast take us some where.
Good one, Change to workflow should not be an issue, but we should have IV core support and reasonable to pool of money (not peanuts) to make this a success. I would recommend to run a funding drive, specially for this effort once IV core endorses this effort. In day to day life, Everything begins with $, you get what you pay for and nothing is free.

The idea is interesting, but I am not convinced. I am a skeptic. Becacuse the question is how will anyone be able to make this idea into reality. Someone should manage a timeplan, budget for this bill. We also need few people to go to Capitol and talk to media and Senators. We need someone to become a leader of this idea. Without a leader and timeplan I cannot buy this idea.
