I am on OPT right now and i got approved MY H1 it is going start from 1st of oct.
But present i am not working. So i decided to go for OPT Extension is that possible.
1) In case my employer with draw H1 then can i apply for OPT extension with new employer. Is that possible.
IF yes how long it takes to cancel the H1 and updates MY SEVIS. And what is the process
for applying extension.

My H1-B got Accepted but I didnt recieved my I-94. I completed my masters here. There are no status issues. My OPT will expire on Dec 27.
I applied for H1-B amendment under Premium processing but i got query of Company documents and 2004, 2005 paystubs.
My employer answered them that employee is not there in the usa in those years. Below is the response from USCIS
Current Status: Response to request for evidence received, and case processing has resumed.
On October 09, 2008, we received your response to our request for evidence. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. You should expect to receive a written decision or written update within 60 days of the date we received your response unless fingerprint processing or an interview are standard parts of case processing and have not yet been completed, in which case you can use our processing dates to estimate when this case will be done. This case is at our CALIFORNIA SERVICE CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. An L-1 work visa is issued to an executive of a company that has worked with his/her company outside of the USA for at least one year. Dependents receive L-2 visas and a spouse can apply for an EAD. Trouble is, if the exec is laid off, all of the dependant visas immediately expire and both the exec and his/her spouse must leave the USA!
Any ideas how to alleviate this issue? Getting a H1B visa is impractical since they are so scarce.
Also in this case, is the exec's employer liable for relocation expenses?

The idea of a H1 transfer is a misnomer. Every application is a new H1. However, if you already are in a valid H1 nonimmigrant category then your new application is not subjected to the cap.

There is one way to find out if CIR is any good for EB - by looking at the bill when it is proposed bill and amendments. It will be suicidal to assume that CIR is somehow bad for us, and incriminate any effort for CIR. My point earlier was not that CIR is bad for EB, but about the actual reason for Sen. Reid's recent comments, just to set the expectations straight.

I am on H1B visa. My visa expires in April 2010. I was arrested in New York for a misdemeanor charge which was subsequently dismissed by the court. There was no guilty plea etc so under immigration law too I DO NOT have a conviction. I have all the final court docs. I am travelling to India to renew my H1B visa. I have a few questions -
(i) Is there a possibility that I am selected for 221 g screening? How long does the 221 g screen take?
(ii) Since I have a valid visa am I allowed to enter the US while they are completing the process? I have left the country before and entered on my current visa. I was sent for additional screening at the airport but had no issues since I have all the court documents.
Any insights would be appreciated

I am not sure what you mean by 3D designers think they have specialty skills?!
First off you don't have to be a designer to model objects that already exist in real life. You just need to know how to use a 3D Modelling program.
And second - yes - it is a skill to be able to use those programs and even more so if you are actually creating an original design.
And dont go to the "viewpoint" D'espano" or other sites for models they are extremely expensive as you say.
As a side note - depending on a model needed by someone you can ask what you need and alot of times people will create it for you for nothing ;) or have it in stock!

My Company applied PERM in Sept'07 at Chicago. Till now company hasn't heard back yet and now employer is planning to file one more PERM appl. through different Lawyer. Can we file one more application without hearing/know the first case status?

you should not file another perm appl unless it is different job duties. you lawyer should call dol. it takes min of 8 months for perm filed in 07.

Remember, you are signing each and every form. Which means you are certifying the following: "I certify, under penalty of perjury under the laws of the United States of America, that this application and the evidence submitted with it is all true and correct."
So when a form asks for your address, it HAS to be YOUR address. Providing any other address would be illegal. Tell your employer he/she cannot force you to commit perjury.
