    Guys,
    I applied that way. I had to take the letter of completion from the school. Luckily I had a research credit to which I got a grade for and it completed my degree requirements. So I got the letter from the school as my lawyer said that I could not file for H1B Masters cap otherwise.

    They had filed me for the 65000 regular cap before but they told me that I could apply for the Masters cap only if I have the letter, I got it from the school.

    But there is a catch here. Due to all this I have two different dates on my OPT and H1b for finishing up the requirements and hence my OPT is bound to get rejected I think since it would be saying that I graduate in May and my H1B would say that I finished in April.

    Trying to figure out if there is a way to stay here in US without having OPT. or else go back and get the visa stamped.

    If he goes to cops what happens to his 485? He is worried that's why he is on this forum - I think he was looking for posters with similar experiences and whether complaining to cops worked or not.


    Is 485 the sole purpose of our life now ? Personally I don't give a damn about the GC if I have to see my family suffer and I don't think any crime can be worse than seeing an adult abusing an infant who can't protect himself and not doing something about it.

    Hi friends,
    No doubt this is a great idea and also as newbie2020 suggests no point of wasting time and loosing the current tempo and massive support of IV members on this regard.
    Would like to request all, is it possible to change the bridge schedule a bit to 9.00 or 9.30 PM EST so that it would be easier to participate for people who are in Pacific Time Zone? If most people have difficulty in doing that, lets move forward with the current schedule.

    But I do not know how many would be EB-2 India in 2004 between Apr.-Dec.

    I looked at the links you have provided and I'm still not sure where your "50,000 EB2 India Labors...." came from. These numbers do not seem trustworthy or reliable.

    Here's data directly from the DOL ETA website.....
    3/28/2005 to 10/28/2005 there were a total of 15973 Labor certifications approved - that includes EB1, 2, 3, 4 for all countries, and 3734 cases for Indian nationals in EB1, 2, 3, 4. Of course a part of EB1 and all of EB5 don't need labor certs.

    If you download the database from the DOL website, apply filters for India, approved cases, then filter out all Level I in all non-managerial occupations, followed by non EB2 job descriptions - you end up with ~ 8 - 9% approvals for EB2-IN which is approx 1300 - 1400 primary applicants.
    In my estimates, i removed most computer programmer level occupations as the USCIS has been very reluctant to approve EB2 for these cases - i could be wrong here.
    As you see, it is IMPOSSIBLE for EB2 IN cases between 3/28/2005 to 10/28/2005 to be much more than 3800 (that is approx 3800 x 2 visas incl dep).
    A total of nearly 50000 EB2 IN applicants (including dep) for 2004 and 2005 may be possible.

    The massive retrogressions we are seeing is mainly because of the fact that only 15439 EB2 visas were issued in 2003, and 32532 i 2004 thanks to DOL backlogs and mis-interpretations of the law by DOS !!!! compare that with an average of 43,000 in most other years since the 1990s.

    I'm pretty confident that your numbers are incorrect

    I am going to take the liberty of putting together an agenda for the conference call, just to make it more productive. I can play scribe for the call.

    The call will be for a maximum of 60 mins, unless someone wants to take it longer than that.

    1. Quick introductions - State your name - GC application stage. - 10 mins
    2. Brainstorming session -- 20 mins
    2. Volunteers who want to be part of the smaller sub-group need to come forward. -- 5 mins
    This is purely to get thoughts/ideas streamlined. Everybody needs to chip in once the action plans are drafted.
    3. Volunteers to exchange contact information. -- 10 mins
    4. Miscellaneous -- 15 mins (if needed)

    Please add more items if you feel they are necessary.

    I will try to scrape all the ideas generated in this thread and will summarize for the call. If anyone wants to post more ideas/comments/suggestions/criticisms, go right ahead and post.

    Good idea to have a conference call.
    Create a team of people who want to actively take part in such effort. These people will be leaders and will do all the planning and execution.

    We will provide support for the functioning of this team.
    Work on various ideas and see if they can be implemented, are as per current law and regulations.... What kind of budget do you need and can help raise etc.

    We will provide guidance during the process if you need it. Also explore the possibility of a big lobby day in DC and create a team of participants for it. We see this event as a possibility in the near future to push our advocacy efforts.

    Hi,
    I am married and my husband is working in US on H1B visa. I came into the country with an L1 visa in Dec '06. The I 94 is valid till Oct 2009.
    In Apr 2007, I applied for my H1B and it was approved with a start date of October 2007.
    I quit my company by end of May 2007. Since the H1B was NOT applied with COS, I applied for my H4 last week but I have not got the approval notice for H4 yet. :(

    Is it still possible for my husband to file my 485 along with his? What do I enter for questions regarding my current status?? Can I say that my current status is H4 and give the "valid till" date as the end date of my husband's H1B date?
    Please help!!!

    Please stop using condescending remarks. I have been reading all your posts and your tone is going from bad to worst. It is not possible to place all the threads on the home page. We make a decision to put threads on the home page that we believe are important for our effort. If you feel otherwise, that is ok. But it is not ok for you to use derogatory language. If you feel so passionate, why don't you start your organization and spend your time, energy and resources and advocate for the cause instead of posting derogatory messages for others. It is very easy to fire when the gun is on someone else shoulder. We understand and share the frustration with green card delays, but that does not give you license to use derogatory language. Everyday there is new thread asking for update, leadership, direction etc. It is not practical to reply to every such post on this forum. That too does not give you license to use derogatory language. In last over 2.5 years we have answered many thousands questions in forums, emails and phone calls. I have heard many a times from my fellow team mates that not once did anyone receive a Thank you note from someone after that someone was fully able to resolve the situation after receiving reply from my colleagues at IV. None of us spend time on this cause to receive a Thank you note, however, posts like yours makes us wonder that are we a community of thankless educated immigrants who are so obsessed with our individual case that all that we want is instant gratification to exactly know the current status of our green cards, without which automatically IV is at fault. Just so that you know, people spend 30 sometimes 40 hours a week over the period of years, just to read a post from someone like you. We received a call at 12:30am yesterday from someone asking about changing to another company because his current employer was not being fair. So when you mock, please make it clear that you are not the one standing in the line of fire and you are not the one who wants to stand in the line of fire. You just wants to be the one to mock and ridicule. If you are serious about taking the baton, please let us know your phone number and we will post it on the website so that people can call you when they have a question. Lets talk about passing the baton, how about we start from posting your phone number on the website, lets see how you take that challenge. No one is paid to work on IV. People spend time on this effort out of their good-will and passion for the cause. So please be respectful towards others for their efforts. And please stop being a pain in the neck and talk some sense if you are serious about picking up the baton. Email us your phone number and you will see it on the website within an hour.

    It has been a real busy year with long working days and multiple complex projects that have been taking away my weekends when I first saw the news about Advocacy days planned by Immigration Voice in Washington D.C. That was definitely not another thing I had time and energy for. My first thought about the event was that I will make it if I can. As days went by I did not want to miss this event. I thought I would regret if I missed this. After a couple of years of no talks about immigration, Advocacy days provided a good opportunity to focus and advocate for issues we all have been living with for many years with many more to come. My vacation request was sent for approval to all the project managers I have been working with and got approved.
    I landed in D.C saturday evening and went to the situation room on Sunday. The situation room was filled with passionate people who have made a choice to dedicate their time to advocate for issues faced by our community. All of us had a lot to accomplish over the next three days. Every one of us had anywhere between four to eight meetings with people who write laws that shape this nation and determine its future. There were a few events happening in the situation room throughout the day like registering members, giving out meeting schedules, tracking schedule changes, training members on how to handle meetings with law makers, mockup lawmaker meetings, preparing meeting materials, printing business cards, making sure everyone has necessary accommodation, making sure everyone knows where their meetings are, who their team members are etc. Towards the end of the day, former USCIS Ombudsman made a visit to the situation room and told all of us how important it is for us to take our issues to law makers and keep up with the work we have done when we go back home. Things don�t happen in life if we don�t try. He really felt bad for all of us who had to walk between House and Senate offices for our meetings over the next couple of days. It was around 11 PM when most of us were ready for the next day. I met my team before I left the situation room and I knew our team was high performing and would do really well. A few people stayed back to finish up and it turns out everyone who stayed back were up until 4 AM.
    We had five meetings scheduled for day 1 in three different buildings on the same side of the capital building. We picked up an additional meeting over the ones we were already scheduled for since we had additional time. Everyone we met knew our issues and were very supportive. No one needed an introduction. Our team accomplished a lot on day and we felt really good. Towards the end of the day and my foot started screaming. Walking between three large buildings which serve as offices for House of Representatives and climbing steep staircases gave me one less blister compared to what I normally get after finishing a half Marathon and next day was not going to be a day of rest.
    My second day turned out to be more exciting compared to the first one. I had five meetings scheduled and I was going solo for my first two lawmaker meetings. I had an opportunity to give a process overview of obtaining permanent residency (Green Card) for highly skilled legal immigrants in one office and that felt really good. After my second meeting I met my IV friends from Southern California and we all headed to our next meeting together. We went to the Rayburn cafeteria to get lunch after. Just when I thought I had luxury of having a 90 minute lunch and only two more meetings to go to for the day my foot really started screaming. The dress code on the hill did not allow me to take my shoes off and stretch my foot or wear sneakers. It felt better to sit for the next 90 minutes in the cafeteria compared to walking or standing. Our next meeting was in the Senate building which was on the other side of the Capital. Normally it would take about 10 to 15 minutes to walk to other side but it took over 40 minutes to reach the office we were supposed to get to only to find out that our meeting got rescheduled to 4:30 PM. I had a 5 PM meeting scheduled as well which did not give me enough time to stay for this meeting and head to the building I came from earlier. I split from my team and started walking towards the other side of the capitol hill for my 5 PM appointment almost an hour early because of my foot issues. I couldn�t really walk for long after I left the senate building. I walked to the nearest bench in front of the capital. I didn�t care about anyone watching me and just took my shoes off and sat down for the next 30 minutes before I could walk again. Our 5 PM meeting was with a Congressman himself and had a Core team member, myself and another member who was later offered an unpaid Internship by a lobbying firm. Just when we were wondering why the position would be unpaid we were told that the reason for being unpaid was because the green card process for the member accepting the position would be reset since It would not fall under same or similar category which made all of us crack up.
    Our next stop was the congressional reception which gave us an opportunity to spend the evening with present and former USCIS Ombudsman, representatives from law maker�s offices, personnel from our lobbying group and a few prominent Immigration attorneys. Our reception was wrapped out around 8 PM and we headed to the situation room for our closing meeting. Our closing meeting went on until 11 after which each one of us took our Action items and next steps to take back to our districts. Everyone we met over the past couple of days told us to keep up the work we have been doing for the past few years. Good work and great follow through always leads to good results.

Nothing new, we have seen this story repeat countless times.

    I have been following this thread and some posts suggest that the Observation on the passport for correcting the name is sufficient. Here is my situation:

    My passport had the name as:
    Surname: A***********
    Given name: P****

    The correct name should be (since this is how I use it in the US now and it applies to all my docs here - GC, DL, school records, everywhere).

    Surname: P****
    Given name: A***********

    I got this corrected in the Indian passport through an "Observation" on Page 3 which states:

    The name of the passport holder appearing on Page 1 has been corrected to read as:
    Surname: P****
    Given name: A***********

    Since this is not a "name change" as such but simply a re-alignment of the last and first names (often a source of confusion from India), I hope this is sufficient and I don't have to go through a name change to get a new passport book issued.

    Any comments would be greatly appreciated.

    Guys/Gals...

    Sorry but do not want to be a damper... But this thread does not give me the right feeling. I have been a member of IV i think from dec 2005 and contributed quite a few hundered dollars and just like this organization as a simplistic, good non-profit orgnization with good intentions....

    But in this thread we see a taunt... which is more like we will not have numbers in DC and then some triades...

    So far whenever such type of hate comments are posted, I have noticed that the IV core/ Super moderators either close the threads or blacklist the user....

    But in this case we see periodically (i think a couple of times) that super moderators are only making comments that we need to prove numbers so join the rally....

    Sorry to say this but i feel either this stage managed ( the triades) or super moderators/ IV core are taking advantage of this thread.... Both I feel are inappropriate....

    If I am wrong in what i have stated - My apologies to Supermoderators / IV Core.... But If I am right then I think personally it is a sad day since it lowered the image of IV in front of a great admirer.

    Go to the authorities and report her.
    H1 is a temporary situation. Your family is permanent. Protect your family.

    Do not let the fear of social services coming to check on you from stopping to do the right thing. They have a job to do; they will not take away a child unless they really believe that the child is not being cared for. They do not want to add to the strain of foster care system which is already under stress.

    Law enforcement agencies also monitor sites like IV, Rajiv Khanna etc. And they can get a subpoena against IV to get your information if they suspect that a crime has taken place.

    Everyone: please please ... You should not only check for the cleanliness and background of the staff (and facility) who take care of your kid. Also make sure that their way of taking care of your kid meets your expectation. Do not make any assumptions. Ask pointed questions and get certain answers.

    Also... I feel that there is more to the story than what the OP has said in his one and only posting.
    I think he/she already went past the point to think "what will happen to me" when they hired someone knowing that she was not legally eligible to work/provide that service.
    If not them reporting that nanny, her next victim will report her. I strongly believe that, if she is used to that way of raising a kid, she will hit other kids in the future. And they will be exposed at that point when the authorities grill her to spill the beans on her previous employers.

    I am also afraid that the OP might take matters into his/her own by making an emotional decision; and that would put him in hot water.

    chanduv: I read your post about how you hired a nanny based on your parent's monitoring her behaviour around your kid when they were visiting you. I hope that was not the only criteria for you to choose her. Keep in mind that a person's behaviour when they are alone speaks of their true nature. They can behave nice and good when they have company; but do they continue to be the same when there is no adult around them?
    Definitely install a nanny cam that you/yourwife can keep checking from work.

    Sorry if I sound like I am picking on you Chandu. But when I read your post, I felt that there might be other families who have done the same thing as you did.

    After going through this thread - I just spoke to my wife about installing a nannycam :) though she strongly feels it may not be necessary because she has developed some kind of friendship with the nanny, but I will definitely install a nannycam.
