Also, one small suggestion, we can just maintain a small excel sheet, to just see who (just the user id and not the actual name) contributed and how much money they contributed just in this campaign. Cos, I hate to say this, I just dont want to be around those who want to have a free ride from all the hard work that IV group is putting in. Please everyone please donate. If you are reading this post, if you have not contributed earlier, please contribute. Dont you want IV to become strong financially when fighting this tough case. They need all the help they can get. I decided to move to india now. I have I140 cleared and having a permanent job. But enough is enough!
I started looking openings at india 2 weeks ago and most probably will get a offer from a US financial giant having IT shop at bangalore.
I think this is right decision at this time.
Any suggestions/feedback guys?

1) We got a spike in new membership and funds
2) We now have atleast 2 more NATIONAL publications who have taken notice of our activities and are more sympathetic to our causes. They feel we have a compelling story and they are interested in publishing about our plight...
In fact two IV members are being interviewed today by a leading publication.
and the most important
3) We got additional material to provide to senators and their staff...this really helps as we do not have to establish ourselves....our stories along with newspaper articles help make our case much stronger....
When we initially started meeting senators, their staff would ask QGA 'Immigration Voice, who or what is that?'
Lately when we go to meet them, most of the staff have already visited our sites multiple times, know about us because of phone calls and faxes by members and ofcourse the articles that have been published....on top of this when we provide stories of members from their constituency, 50% of our work is already achieved....the liason team and QGA take over from there.
So to answer your question, yes it helped a lot

After getting the form notarized (from a UPS store that has a public notary available), I made a second trip to the consulate and was able to submit the documents! (btw, I was in the queue for 1.5 hours!,,,Those of you going to the NY consulate, make sure u get there when doors open!)
Something new had to pop out.. So, after submission I was told the process could take four weeks because they need some sort of clearance from the consulate that issued the original passport. first: my use of an extreme example to explain the EB category difference seems to have caused misunderstanding and offence among some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.
i did reply to some of the posters by pm and had some intresting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...
qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.
now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thread?

According to a specialist on immigration forums "Mr UnitedNations" the unused visas are directly being used for EB3 ROW , I am not how he knows that but maybe thats what is happening.
Maybe EB3 ROW being a diverse group is being given more precendence than highly subscribed countries.

I just want to generate enough internet chatter so that the issue of substitute labor will come on CIS radar. I know for sure that a huge fraud was perpetrated during July 07 fiasco by some unscrupulous consulting companies who sold pre-approvevd labors like frozen pizzas. Just heat and eat.
And I also know for sure that IV has gained enough publicity that CIS folks might be tempted to check it now and then. May be they will take notice of this thread and start investigation of all the subst labors.

Please educate every one you meet in your community, friends circle and help others who do not know the laws and risking their kids life.
The thread has been filled up with mixed responses of some threatening, supporting, uncontrollable anger and attacking, don't bother much, as it is a way for ourselves get educated, because most of us here have kids same age as yours.

it goes deeper than that. first let me point out that this is philosophical- you argument is not about law, it's about a point of view.
so if i ask you why EB2 filers should spend extra years getting educated and never getting this all important magic "PD" and then get in line behind someone who got a job the day they entered the country- and got a PD soon enough- what would you say?
ask me. it took me 11 years to get a PD. why? for 7 of those years i was getting my advanced education. so why should i suffer behind the 3 year Indian degree person (against my 7 years there as well) who came in 5 years after me and filed right away?
there are reasons why the EB priorities were set up. by simply extending your logic EB1 should also wait for a turn and not have priority. what's good for the goose....
having said that, it is absolutely insane to ask people to wait indefinitely and we must do something about it.
today the EB3 folks (and I have nothing against them, their waits are insane- and it's absolutely not right) are porting to EB2 with those bachelors degrees and 5 years experience. and just because they could APPLY for a GC earlier and all their years get counted in the PD, they keep lining up ahead of me. why do all my years count for NOTHING?
please spare us "fortunate" EB2s a thought too. think of when in life our careers are finally freed from waiting for a GC.
and now please concentrate on ways to end retrogression and stop the EB2 vs EB3 crap. we all have our problems.
I should clarify few points here:
1. Let EB2 be wonder kids. All I am saying is their GC shouldn't be at the cost of EB3. Have a separate quota which is twice as much as EB3. But, when the left overs are up in the air, EB2 shouldn't grab everything.
2. Not all EB3 are with 3 years Indian degree. Most of them are 4 years and above. Please prove me wrong. There are several Master degree holders in EB3 queue just because of their employer decision (not even job requirements).
4. Most people filed under EB3 way back in 2001/2002 because they didn't antici pate such a mess 5-6 years down the road.
5. Today most applications are EB2? How? does it mean that the '3 years' Indian degree holders are not coming to US anymore? Nope. These days people just ', manage' to file under EB2.
6. Finally, EB2 would understand what we (EB3) are saying if the EB1 queue was retrogressed and EB2 was stuck in 2001.
There is no separate quota while applying for H1B but at the final stage of GC! Ridiculous!!
Bottom line, a VISA that could impact an individual's life so much should not be dragged for 7-8 years. And, thank you for your concern for EB3.

I am eligible to file for 485 under the current (July) visa bulletin. My wife is transitioning from L1B(expired in May) to H4(Awaiting receipt) and is therefore out of status. I am wondering if she should apply with me (claiming that her status is H4) or should she wait till she gets her H4 (which could be in August).
My questions are:
1. Is it necessary that one's spouse should apply concurrently?
2. Can one's spouse (H4) apply for 485 as a follow up to her husband's application in July even if the visa numbers are not available (i.e in August when the visa bulletin says Unavailable)?

Yup, issues regarding passport should be taken seriously. We need to keep track of all dates in and out of US, name change, correct names, spell check etc., otherwise it will delay the process when time comes.
