Mr Unitednation takes the advantages of ignorance (in immgration law) of most of the forum members and spreading wrong information in both web sites.
Of course he is very informative, however he is very biased and having wrong openion that EB3 India has stolen EB3_ROW number in previous years as he belongs to ROW. He wrongly assumes that till EB3-ROW becomes current EB2 & EB3-India will not see any movement. He thinks no one knows the rules, laws ect..and he is only one knows everything. The actual fact is most peoples have been doing research on retrogression like him last two years and not having enough time to reply his post. To fuel his openion DOS is violating the section 202 of INA and no one cares about this including IV core team.

He is just presenting a neutral observers view point....
As much I have understood Mr. Nations is non partisan...He is already out of this mess and he is doing social service .
But we should listen to all view points....if we need to make a viable case....

Senthil has articulated legal basis of current system. However, many members feel agrieved by current situation. My displeasure with current law was based on my perception about principles of natural justice and a dogma that one measure (current provisions) should not negatively impact others basic rights for happiness, equality, nondiscrimination etc. Courts could take a look at how much damege or injury is possible or actually already resulting (stalled careers, family separation, life on hold, creativity-innovation halted) in current system. Atleast it will open up healthy debate and rational measures to address genuine problems.
Could anybody clarify as to whether counting of family members towards annual quota is mandated by congress or it is an administrative provision.

EB3 quota for this year was exhausted a long time ago. We are not going to see any overflow into EB3 until EB2 has unused visas left at the end of the FY year. Letz just hope that the date moves forward when the new quota starts next month. It was Nov 2001 before it became unvailable. Now that they have quite a few pre-adjudicated applications, they should be able to better forecast the dates it needs to move when the new fiscal year starts. Or, they might just move the date to Jan 02. Letz see in another month what the future says.

Like other people said, take the job and move on. No need to send any documents to file AC21.
I changed job last year and did not send any AC21 document. This year when I got employment verification RFE, my attorney sent a letter from my new employer that I am working on a similar position and also an AC21 eligibility letter. So AC21 can be done if and when you get a RFE for employment.
All is good (at least that's what I think)

1. File for AC21 and then if they raise RFE then chances are i am not be able to respond back to rfe or they delay the process of allocating a visa # for my case. In that case i may loose the sept 09 visa availablity for myself to get GC
2. Do not file for AC21 and hope i get my GC. In case they raise RFE I will try to respond and then see what happens.

I have one message from Pappu that they have some updates on this. I don't know any details so far. Hopefully we will get some account information soon! If not, we will see how to create a pool account for this and then submit to IV. One thing is for sure, I don't think we can not afford loosing this golden opportunity. I don't want to loose this to bureaucracy.

Someone gave me a "red" with totally unjustified reason. Initially I was upset - and I complained about it - found that he gave me more reds with similar comment from multiple userids (because one userid can't give multiple green/red to the same post). And this guy is doing at weird times ..like 5 in the morning (so psyco is the right description ... now I am sure he is going to given couple of reds to me :D )
After rethinking - now I don't care much about reds - someone is just pissed off, jealous or having fun ... red might make us (and our posts) look less reliable ... however I decided to keep my blood-pressure low and psyco's high :D ..so go ahead psyco - add more reds !!

If you too saved thousands of dollars owing to the VB reversal... this is the least you can and should do to help yourself to a GC, a few years sooner than otherwise.

I guess My interview didn't go as expected.
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

I am also in same boat!! no Communication yet eventhoug my company lawyer applied on 2nd april in MS quota with PP.
Which center you case went to? Mine went to California service center ( CSC).
Hope for best!!!
My lawyer and company headquarters are in CA. However, I am going to be working in a different branch. So, I am guessing that most likely my application is in CSC, since I do not have a formal notification from my lawyer as to where he sent it.
I am also in same boat!! no Communication yet eventhoug my company lawyer applied on 2nd april in MS quota with PP.
