Hi PotatoEater !!
What you said may be true for case like some who really applied in Nov 01 is waiting and someone who applied in Jul 07 with a substituted labor of Sep 01 got it. It ends there.
Those are a few lucky fellows, but did it legally.
That doesnt solve much of the backlogs problem even if that didnt happen. Analyze the situation in May 07. It was horrible, right.
It was luck AILA and other groups including IV could contribute to keep the dates current for that month, for our benefit

This is ridiculous. Just trying to blame a good Sherrif.
I am from AZ and Sherrif Joe is the best and the whole country should be proud of him.
He is doing the job which is supposed to be done by Federal govt and ICE, trying to take care of a border state county.
Well you always have critics when you are doing a good job or he wont keep getting elected again and again.
getting re-elected doesn't mean he is right or he is doing a good job..... bush was also re-elected in 2004..... does it mean he was doing the right thing...... ask majority of americans they will spit on u'r face.... the same guys who were head over heals in love with bush back in 2004..... it just means that the majority of people who voted were stupid..... democracy has a curse..... that it has to live by the majority opinion which is not always right or good..... and using this curse as a weapon..... some men have made fool out of the majority.... in counties, cities, states and countries..... across the world..... so don't throw this bullshit of getting re-elected to legitimize an in-humane behavior.....
y don't u file taxes for your employer...... or sign papers for your ceo..... is that not within u'r jurisdiction? in that case how the hell is it legal for this shariff to do things which is not in his jurisdiction..... its not that he is doing his job..... its that he is stepping out of his legitimate authority & boundary ....... even when feds have told not too...... & he is getting the illegitimate cover under the so called re-election bull crap.....
constitution has clear delineation of powers between federal and local governments..... & immigration status is a federal issue.... it cannot be changed by a vote in a local area.....

If the news is correct then it means no visa waste this year.......
The bigger question here is .......Are there any IOs sitting at the fingerprinting place . If yes, are they authorized to give out such info or even entertain any such requests ??

USCIS UPDATES COUNT OF FY 2008 H-1B CAP FILINGS
WASHINGTON U.S. Citizenship and Immigration Services (USCIS) announced an updated number of
filings today as the counting of H-1B petitions received on April 2 and 3 continues. On April 3, USCIS
announced that it had received enough petitions to meet the congressionally mandated cap for fiscal year
2008 (FY 2008) and that it would conduct a computer-generated random selection of cap-subject petitions
filed on Monday (April 2) and Tuesday (April 3) to determine which cases would be accepted for processing.
As of April 9, USCIS has determined that approximately 119,193 of the H-1B petitions received on April 2
and 3 are subject to the FY 2008 congressionally mandated cap.
USCIS received on April 2 and 3 a total of approximately 12,989 cases requesting an exemption from the FY
2008 H-1B cap because they were filed on behalf of aliens holding a masters degree or higher from a U.S.
institution. USCIS can now announce that the cap of 20,000 on these exempt cases remains open and that
USCIS will continue to monitor these filings.
USCIS will provide regular updates as the processing of FY 2008 H-1B cap cases continues.
Is this the final number or interim number while the counting is going on.

this got to be the best practical solution I have seen on IV (with some modification?), approaching hillary clinton by explaining the situation is the best bet, its simple and involves an administrative fix but they anyway have to revisit the application during visa allocation,
what if a person's 485 is approved like 4 years back and he had some run-ins with law after that or something that might jeopardize his chances of 485 if it is evaluated at the time of visa allocation? this might be a 1 in 100 case but its a national security issue, solution can be as one of the members said pay an upfront fee for pre-evaluation and then when visa number is available they don't re-evaulate parts of application that don't change like birth certificate etc.,. and just look at w2s, paystubs, criminal records etc.,. in that case if it is just a pre-evaluation I am not sure how it would be of great help unless the package comes with EAD and AP,

your frustration at IV and the core.
You can do that and IV (core or its members) will not bite at you, because we know we are all part of the same movement, with the same frustrations, pain and stress associated with uncertainty. What is really needed is channelling the frustration toward action, mobilization and support at the grass roots.
The opposition is strong. But if we are to succeed, we need to work together. IV work is not easy. Takes time, commitment and money. Lots of people have been trying to do it for a long long time now. But circumstances and uncertainty/unpredictability associated with the legislature and governmental agency(ies) have always been the deterrent for IV's success.
Reversal of July 07 VB, multi-year EAD, Extended OPT etc. - IV has played significant roles. Under tough circumstances, IV has been able to obtain temporary measures that provide interim relief to you and posterity.
The day will come when retrogression will become history. But nobody knows what the calendar date of that day is. I surely hope that the day falls in 2008.
As a start, have you looked at the High-Five campaign started by a IV member? Please donate $5 for that campaign. That is the least you can do.

I like your idea. And I do support it in spite I not being in similar situation.. However with a little bit experienece I have with similar work flow improvement projects I would like to point out that the impact on labour/cost has to be thought through. My understanding is the agency has not been using Visa numbers because they are heavily loaded. Now if you ask them to do this pre-adjudicataion for all cases that will impose a sever load on them. I may be completely wrong here - it could be another department, another agency so this may not be an issue at all.. but if possible think through this as we submit a proposal.. If needed (now gals and guys don't beat me up!) we could even pay them (So they could hire people) to get this pre-adjudication done?
