Few months ago, my company filed for my 7th year extension and USCIS approved the extension for only 8 months instead of 1 year (my I-140 hadn't been approved yet). My lawyers contacted USCIS for clarification and we finally heard back from them. They say that the approval of 8 months is correct and gave no explanation for why it was not for 1 year (which I would have qualified for since my LC was approved when the extension was filed).
Has anyone else experienced a similar thing?
Check with you employer on the validiity of the associated LCA. At the time of your H1 approval, there might have been only 8 months of validity left on the LCA. Other reason could be, assuming you are working for a consulting company, USCIS might have given you an extension till the end of the current project. I have seen several cases where USCIS only gave 6 month extensions because the project PO was only valid for 6 months.

On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.

Hi,
I just became unemployed (today) but I obtained my GC through employment about 2 years ago. I have some questions:
I am planning to spend about a week or 2 in Canada, will that cause me any problems when I come back to the US? I will keep job hunting in Canada but for a job in the US as I intend to stay in the US.
Am I entitled to unemployment benefits since I have a GC?
Will my layoff create any problems for me when I want to become a citizen of the US in about 3 years?

My CP interview at Montreal in September 2008 (EB2 � India), I have few questions before interview.
1. Do I have to get Affidavit of support or income come Tax Return from my sponsor company?
2. Do I have to file Affidavit of support for spouse and children
3. As my passport is going to expired I need to get new, Do I have to inform NVC/ consulate before Interview?

I am in the same situation.
I am applying H4 for my my wife, but the question 3g in Part4 , i am not able to make a right choice
Yes if she has worked after admission in the US - Qualifies for this
No if she is going to be dependent on my H1B - Qualifies from the date of approval
What should be choice in this case as she will have worked for 10 months before getting the H4
We also need to provide employment details on part 4 continued section for both Yes and NO
can somebody throw some light on this?

My husband is in H1B visa and he transfered his visa to another company. Got the I-797 approvals too. Along with that mine and my kids H4 also got approved.
Now I am urgently required to travel to India, and want to return from India without going for stamping. Here are other details.
1) Even my previous H4 visa is not expired while I return from India.
2) I have the new H4 approval notices and copy of husbands new H1s I797 with me.
Will it be an issue if I reenter without stamping. Our plan is to go for Visa stamping to any nearby consulate in US border after I come back. Please advise.

I am in the middle of H1-B transfer from Comp A to Comp B.. I have an urgent question,
Company A didn't run my payroll from 11/26/07-4/11/08 because i was out of the project,since then i have had a consistent payroll no gaps, my question is
1.will that affect my H1-b transfer?
2.will USCIS go back that far to verify my paystubs?, and

I had ask these questions on the attorney calls few months ago and this is what i got from it.
The questions are:
1. Can I file an extension of H1 with pending MTR and with less than year old labor application?
- No, need to have approved I140 in your case.
2. Is it legal to stay in US after May 2011 while MTR is pending and H1 extension is filed before expiry?
- Cannot file H1 extension with that
3. In case, if the MTR is denied, would the illegal/out of status will start from 15th May 2011 or from the date the MTR is denied?

They may not accept a certificate from india, medical exams has to be done by a civil surgeon in your area who is authorized to perform the tests.

Ah. It doesn't end even if you get the GC! I agree with the others - go for the interview fully prepared with all the documents including your GC. Even though you have the feeling "what if they revoke it?", it is best to comply with the laws and respect the interview notice.

I currently work for a leading film company in the US and hold a senior position under a O1 non-immigrant visa. Last year I applied for my GC under EB3, which was the choice made by my company . My priority date is Jan 2008 and I recently had my I140 approved. However, I have heard that given my work history and experience, I may possibly qualify as EB1 if I did not apply through company sponsorship. My question is, can I simply cancel my current application and re-apply myself under EB1 using my own lawyer? I am really hoping that I can change this category as the EB3 situation seems to be completely ridiculous.

You do not need to Cancel EB3. You can apply in EB1 separately. They are totally independent.

not sure about I-140, i think it should be ok to mention your spouse name but check with your immigration lawyer about this.
NOTE: as far as i know, if your wife is in H4 visa, you can file her AOS (I-485) as your spouse. But if she is in F1 visa, you CANNOT file her I-485 as your dependent along with your I-485 since she is in F1 student visa. but check with your immigration lawyer about this..

I came in US on 5-Jun-2006 on L2 visa & then changed status to H4 after 6 months & then applied for H1 & started working & now I'm on H1 & now I want to go back to H4. I never left the US during these change of status from L2 --> H4 --> H1
The Part 3 of form I-539 is asking below questions:
1. I/We request that my/our current or requested status be extended until***** (mm/dd/yyyy): __________
Here, actually, I'm applying for change of status & not extension. Should I write N/A or the I-94 expiry date of my spouse's H1 petition?

:confused: I have another question concerning EAD. I have a valid h1 visa stamped on my passport till June 2007. I have EAD and AP as well. On my return from India last month the inspector at the POE did not let me enter on my h1 and instead asked me to use my AP. He stamped my I 94 as entering on AP but he did not cancel my h1. Now what status I am on? H1 or AP? My EAD is expiring on 23rd Jan 2007 so if I am no longer on h1 then would I have to come out of job till I get another EAD? Won't this make me go out of status? Please advise.
