Should not be a problem. I used Cobra while I am on H1 and changed the Employer.

Your lawyer is very much on the point, H1B is valid only with the Job. Either H1B COS or H1B stamp outside US, you should have the Job offer in Hand, to be on H1B status.

Hello,
I am working on H1-b visa. My green card stage: Priority date July '06, EB3, India. I-140 approved, I-485 filed Sept'07. I don�t intend to use EAD for employment now.
I have a need to get my future spouse on H-4 visa. With EB3 India priority dates retrogressed, filing dependent I-485 for spouse is years away. (Unless rules change!)
Question 1: IF I loose my H1-b status (job loss) and find a new job using my EAD, my spouse on H-4 goes out of status. So what all options do I have to keep her in a valid status?
Question 2: Proactively, say my spouse (when on valid H-4 status) starts a Masters program (part-time) at a University, can she file for a H4 to F-1 change of status (COS) that very week or month I loose my job. Or are there any serious timing issues in this option?

When the new company (for profit) applies for your wife's H1-B, it will be counted against the cap.

Hi,
My pending I-140 (filed an year ago...June 2006) was transferred from TSC to NSC on 09/05/2007, because my I-485 was filed with NSC. What date willl NSC use as received date to process my case...the date they received from TSC or the original receipt date?
Isn't it(140 filed at TSC almost an year ago) supposed to be certified by now?
TSC has been much faster at certifying 140s . Looks like USCIS is transferrring the 140s from TSC ... I can only pray for alll concurrent fileres that filed at TSC ...
140s at NSC are almost taking an year according to latest processing times.

Usually, even if the employer or attorney put their address, the USCIS mails the card to the address marked as the home address of the applicant.
Note that the I-765(EAD) and AP are not mandatory forms. Talk your employer into saying "these are not required right now, we can file later". And once he files the 485 and 140, you can always file the EAD and AP yourself (or use a lawyer).
I have a feeling he's trying to keep all documentation to himself. Don't let your guard down.
Purely my opinion.

Matthew Oh is reporting that the USCIS is planning to deny EAD applications filed more than 120 days before expiry. Source is described as correspondence to AILA from the USCIS. Hmmm!
I thought I read somewhere on their website that we should apply 180 days before expiry.

Hello,
We just received the ASC notice for biometric notice. The date they provided is the same date where we have an appointment in Mexico US Consulate.
Any experience for re-scheduling the biometric appointment. We would like the appointment to be earlier.

You can say like....around Oct-15-2007 or so. This letter is on top of Passport, birth certificate and PR card.
