    Dear newbie2020, QASleuth, NolaIndian and Others,

    I will be there for this conference call.

    Sorry folks for staying away from the communication going on in this thread for some time. I am personally going through some changes now. This Wednesday evening I came to know that my present job assignment is going to end shortly. (Fortunately, I have a new job offer). Now I am in the process of trying to get into this new job and it will take time to get adjusted to this new job. This means, I have to leave my H1b and use AC21/EAD to accept the new job. I had a conversation with one of the attorneys of Murthy law firm regarding all the Pros and Cons of my Job change. I documented the whole conversation and will be posting that to this site shortly for everyone else's use.

    Even though I just posted this idea in this site, Guys please don't wait for anyone else's leadership. If you feel you can take this up, please do. It's your idea too. Do not give ownership of any idea to anyone. Why I am writing this at this point of time is I am going through some job transition for which I need a month or 2. So, my participation in this effort may not be up to my own expectations. However I will do whatever I can during this period and much more once I settle in my new job.

    I guess My interview didn't go as expected.

    1) I reached the office an hour early.
    2) After waiting,they did security check and let us in
    3) Then the lady who was assigned my case, came and took us into her room
    4) Oath, etc
    5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
    6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
    7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
    8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
    9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
    10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
    11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
    12) She said she will look at DOS bulletins
    13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
    14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
    15) She said, you would think so..but they accept many times..so we are told to verify all the time
    16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.

    17) We had no choice and we were over the interview. we were little disappointed though

    18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo

    19) I went back an hour later with the print out
    20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)

    21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in

    22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)

    23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
    then she asked, I am sure you didnt come back for I-94 alone, did you get any document?

    24) We showed her the memo.

    25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

    26) We waited for 2 hrs and then she took us inside.
    27) Asked our passports (to stamp...really)

    28) Then she looked into the computer to get the visa #.
    29) The we noticed a changed in her face and then she quickly turned into a folder of current VISA bulletin..we said..oh..no..not again.
    30) The officer said, per visa bulletin u r current and ur PD is dec 2005..there is no reason for system not to allocated a visa #..
    31)She tried for 10-15 mins and finally gave up..said she cant stamp in the passport without allotting the visa number..said sorry..I cant do anything..I will follow up with DOS ppl and will let you know in a week or so.

    32) The reason she gave is, when she tried to allot the visa, she got a message, "cut off date not established". I have no idea what this means.

    hmmm....still keeping fingers crossed..this is nothing short of a car race.

    This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

    I think I know a few with PD < 2002 still waiting....Its hard to give up when you have waited so long....


    Of course there are many, may be thousands who are waiting since 2002 or earlier. But the logic I gave was that these guys must have already filed their their AOS petitions in the interim years.

    My point was that, there is no way so many ancient labors (pre 2001) can get cleared last month and cause depletion of visa numbers. There is only one explanation. These labors were pre-approved.

    Well, I just successfully contributed my 2nd $100 to IV. There is just no way we are going to give up this time. It is not going to come easy, especially not without the relatively small financial sacrifice. But the return --Immeasurable peace of mind and relief.     It is always advisable to take an Immigration Attorney with you during an AOS interview. Attorneys usually fill in when you pause or are uncertain. Thanks for sharing this information - looks like this is a very generic interview.
    The most important question was - to know if your educational qualification is good enough for the job and all other questions were just fillers.

    We had our AOS interview this week at LA USCIS office. We are EB2-I, PD 02/06, Filed 08/07, RD 10/07, I-140 approved 12/06. Reason for interview was a double failure to get clear FPs for spouse. This necessitates a police clearance certificate from the city of residence and upon our lawyer's advise, we went armed with two of these, one from each of the two cities we have lived in during the 5 previous years.

    Getting a Police Clearance Certificate entails just going and requesting it at their counter. Their charges are reasonable ($11 and $19.50 for us) and in one case we got it after a few minutes of wait and in the other, had to return the next day to collect it.

    We reached a couple of minutes late at the mapped location of the USCIS building, courtesy our unfamiliarity with downtown areas including LA and terrible freeway traffic. I dropped off my spouse and kid at a building which had bold signs saying "Passport", "Immigration" and like (on our right as we went on Los Angeles St from Aliso St to Temple St). I went to find a parking space meanwhile. Just as I was returning from an uncomfortably long circuitous tour of the area, I got a call from my spouse telling me that that building was not the right one. Our GPS had finished guidance just at that particular crossing (Los Angeles St and Temple St) btw. Through some good people there, we got a clue about the long lines in a nearby building (diagonally across), which is where I dropped them off then and again went on a parking hunt. I wish I had also carried a map printout of this area.

    I managed to find a parking some 6 blocks away and was walking back with some bags which is when my spouse called to say that this was indeed the right building and gave me further directions.

    I sprinted across a narrow side street when it was bereft of traffic even though the pedestrian light was unfavorable. This act of mine earned me a citation from a peace officer obviously watching from a hiding place for people who are more used to pedestrian crossings with buttons. Here I was just not sure as to when to expect the light to turn in my favor, with obvious thoughts of the delay playing on my mind. Thankfully, I still reached upstairs well before our names were called.

    The security at the downstairs entrance was airport-like except that they did not ask me to take my shoes off. They allowed me everything I was carrying including my cellphone and laptop.

    I duly reached the waiting room upstairs and found my family. By this time, my spouse had already submitted the interview notices to the personnel there. Our lawyer had advised us to stick a note therewith saying that all of us are a family and should therefore be seen together. We forgot this but my spouse mentioned this verbally. This had the desired effect, thankfully.

    After a wait of about 2 hours, we were called up and went inside to an IO's office. I do have to mention here that the security officer outside was very nice and friendly.

    The IO was courteous and asked us to take an oath of truth before we sat down. She asked us if we had our attorney with us. Since we did not, she made us sign a waiver saying that we did not object to being interviewed sans our attorney. She then proceeded to ask us for our government-issued IDs. We handed her our Indian passports and California DLs. She went through our applications and asked us simple questions like:

    ..What is your child's name?
    ..How old is your child? (two separate times from each of us)
    ..What is your child's DOB?
    ..What is your home address? (two separate times from each of us)
    ..What is your home phone number? (two separate times from each of us)
    ..What do you do for your employer? Describe.
    ..Does your job require you to have the educational qualification that you have? Why?
    ..What is your father's full name?
    ..What is your mothers full name?
    ..What is your DOB?
    ..When does your H1B visa expire?
    ..When did you last enter the US? (It helped us tremendously that we had a prepared note of our arrival-departure record)

    The IO then took out the original I-94s from our passports and stapled them to our files. She then observed that both of us were on H1B and had had I-140s from our respective employers. She said that the other I-140 process (which is pending btw) could not be kept alive while the beneficiary was getting their AOS as a dependent on their spouse's process. She had us write a letter requesting withdrawal of that I-140 process, which she said she will keep on hold till we got our immigrant visas.

    Some documents that she asked for copies of from us for included paystubs from 3 previous months, letter of employment verification from our employers, university degrees (or diplomas as she called them), our and our kid's birth certificates and our marriage certificate. We voluntarily put our mortgage statements on the table which she did not take more than a cursory glance at.

    She did not ask us for our tax returns, joint photographs or university transcripts. However, it is always better to have these around, imho.

    We were missing some documents, so she permitted us to go out for a couple of hours to get their copies and grab some lunch. She handed us a signed form which she instructed us to show the security personnel for them to either let us in or to drop off the document copies for her. In this case, she did see us again even though we were delayed by an extra 20 minutes.

    The IO then let us know that all processing was done from our side and all that we needed to do was to wait for our priority date to become current, which is when the USCIS would allot us the immigrant visas. We could also, if we so wished, make an inquiry with the USCIS once our date became current, she said.

    She then returned us all our originals (I wish I had made a checklist of these for my ease). Courtesy a wonderful post on IV by gimme_GC2006, I remembered to ask the IO for our original I-94s. She asked us if we intended traveling before we got our green cards. I replied that we had no existing plans but that this was probably the only time we were getting to meet her. She smiled at that and gave us back our I-94s after making copies for herself. I requested a copy from her of the letter for I-140 withdrawal and she obliged.

    That was it. She wished us good luck and we thanked her. The security officer outside was once again his pleasant self and we walked out feeling elated.

    I have some useful information for folks who go to the USCIS office on 300 N Los Angeles St in LA. If you take the Los Angeles St exit from US-101, you will cross Aliso St followed by Temple St. This USCIS building is the one on your left side as you go from Aliso to Temple. There is an underground parking for LA mall bang opposite the USCIS building before you hit Temple St. After you pass Aliso, turn to your right into this parking. You can take the escalator up later and then cross Los Angeles St on foot to reach USCIS. I advise to not disregard the pedestrian lights in this area as police officers aggressively monitor and cite jaywalkers here.

    If the LA parking lot is full, continue on Los Angeles St past Temple and turn left on to First St. Keep going for about a quarter mile and you will find parking on your right. This place is $6.00 for the day. Unfortunately I forgot the cross street here but if you hit Alameda St on First St, you have gone too far. From Google maps, it appears that that cross street is Central Ave. You will see large parking signs as you approach this decrepit unkempt street-level parking yard. There is another parking option which you would prefer over this.

    Go from Aliso toward Temple on Los Angeles St. Turn left on Temple and you will find this $8.00 parking immediately past San Pedro St. If you find this lot full, go on down to Alameda St, turn right and then right again on First St to find the $6.00 parking lot.

    If you need help with documents, there is a post office store which even does photographs, in the LA mall across from the USCIS building. If you need internet access, your best bets are Fedex Kinko's and Office Depot on the crossing of Second St and Central Ave. Kinko's is on the NW corner and Office Depot is on the NE corner. Office Depot has a Starbucks next to it. Parking at Office Depot is decent and free with validation. Office Depot will give you free wifi but they do not broadcast their SSID and I do not feel it ethical to disclose it here. Just go talk to them if you need it. It is slow though, like 11 Mbps. Office Depot will accept emailed docs from you to print right away and also will accept faxes for you. It is a very hospitable place for someone who gets nightmares in downtown areas.

    You can find some passable eating joints in the LA mall area across from USCIS building.

    I can debate you rationally under one condition; the moment you resort to personal attacks I will stop. I will assume you have a fair grip of English language and decent comprehension skills. If you agree then lets get this rolling:

    First off, have you read the link which I have provided in my previous post ?

    If you did, then I hope you will stop making simplistic comparisons of Mexicans coming into US to lets say Bangladeshi's coming into India.

    No, we ALL do not know that. Even if it is true in every part of the country and in each and every case, it does not make it right.

    "Just one hypothetical question for these people...What if a pregnant female terrorist is arrested by police in India, just before she was about to engage in some terrorist act in India itself, is arrested and is shackled to her hospital bed, while she gives birth...would all of these "human rights supporters be saying these same things..."

    What you are making is called a straw man argument (Straw man - Wikipedia, the free encyclopedia (http://en.wikipedia.org/wiki/Strawman)). In this case, the woman is NOT a terrorist nor
    was she suspected of any such crime, so bringing such hypotheticals will not give any weight to your argument.

    What you are seeing is a case of 'socio-economic' osmosis. Problems of this nature has been debated across many nations of the world. How you handle these issues goes to the core character of the nation. Shooting 'intruders' is perhaps one way of looking at it. Then such a solution cannot be undertaken by a 'super-power' who wants to hold moral superiority in the league of nations.

    A few 'simple' cases of water-boarding people thought will not have any repercussions. How wrong those people were. Similarly, police torturing 'intruders' and defending such actions does not make it right. It just erodes the basic character of the entire country. Would you want to teach your own kids as to how to treat such issues ? Shooting, shackling, water-boarding etc ? Please do not give a flippant reply, do think about it before you hit the submit button.

    Socio-economic solution along with a sensible immigration policy has been found to be far more sensible as compared to a pure enforcement policy. It has been proved over the years that a pure enforcement policy which many nativists support to be economically unviable. Minutemen patrolling the borders to Gov. Perry's multi million dollar border cameras, have proven to be ineffective and economically unfeasible.

    Thanks a lot to all members for being with us in this struggle. We have tasted our first big success this year. Credit goes to each and every IV member. We were all affected by the visa bulletin fiasco and this is our victory. This is a victory for all our members and we must rejoice.

    IV had worked very hard and had been pushing for this in the background. Our flower campaign, rally and other advocacy efforts all came together and helped us at a crunch time. We thank members that sent flowers and also walked in the San Jose heat for 4 hours. All that really shows our commitment to this cause.

    We are happy that our efforts are successful and IV has been able to make a difference. Please also know that during this effort, IV was extremely active and decision makers heard our voice. We cannot give out all the details but what IV members should know is that these efforts should make each one of us proud and what we can do if we have a firm resolve. We were also the first to break this news even before anyone else or media could, and continued to update our members as time passed.

    IV also thanks its contributing members and it is because of their contributions we were able to continue this effort. Many thanks to the members that are contributing now after this good news.

    Please continue your support for this organization and be an integral member of this ever growing community, so that this journey can continue and we can end retrogression and have immigrationvoice as our voice.

    This does not mean we will not be seeing any approvals now. USICS might have assigned the visa numbers to lot of pending EB2 I-485 applications. They will be adjudicating those cases in few days. So folks keep the faith , keep bugging USCIS (call them day and night) and check immigrationvoice.org every 2 minutes and also don't forget to check your emails and uscis.gov website for CRIS updates every minute :eek:

    Original Poster should not have sensationalised this memo. If at all this 'news' is true -this may be just something so-called internal matter. Best interpretion of this 'news' is: They may have assigned available visa#s to approvable petitions just as they did before 2nd July07 bulletin, where people kept getting approvals well into Oct07.

    So, ALL THE BEST to lucky ones who are 'pre-adjudicated'. How else you can explain Sep VB, which is yet to start from 9/1.
