Usually I-485 processing time is 6-9 months. If your PD is current and filed before March 26 2009, you can call and find out your petition status.

IMHO, If you have a valid H1b visa, then you need to be gainfully employed to keep the visa valid and that would mean you continue to get paid. If not, then that that is a problem. Joining the 2nd company on EAD is not a problem. Coming back to the 1st company on EAD is not a problem either. If you want to keep your H!b alive/valid, then I would suggest that you port/transfer your H1b visa to the 2nd company and when you are done with him, transfer h1b back to 1st company.
Seems like a lot of trouble to keep the h1b visa valid, but then again, that is one of the options.

Republican Presidential candidate Newt Gingrich continues to stake out his claim as the sole moderate on immigration in the GOP campaign. Politico reports that he is in favor of a legalization program that will allow "citizen boards" (similar to the draft boards of an earlier era) to determine whether undocumented immigrants deserve to stay in the US. He explicitly rejected a path to legalization. Gingrich is considered a favorite of those in the Tea Party and the candidate's more enlightened positions on immigration support the argument that not all those in the Tea Party are hardliners on immigration.

It seems my company had audit and my employer was asked to submit client letters for all employees.
Q's is will it have any impact on 485 process for the employees in case of any issues in the company in other areas ?

This is allowed since the laws are not very specific yet on 2 concurrent applications even though they recently brought out a rule on multiple filings by one employer and multiple perms for diff. positions for one employer. However you need to puruse it at your own risk. lawyers are happy and might even encourage you since they will get double the fees. In the I140 stage there is a column where you have to say if you have any other immigration application that is pending or has ever been denied. also I have heard that USCIS has been scrutinizing more carefully multiple applications especially after the bi specialization of the centers. Basically you don’t want to give an impression that you are doing fraud, because green card is only for a future employment for one employer. People have been doing this multiple application and labor substitutions in the past and authorities have been coming up ways and means to stop this or pass it through careful scrutiny.

The fees for most CIS applications are astronomical. For instance the fee for N-400 to become a US Citizen is $675/- The fee for adjusting status to become a permanent resident is $1010/- Many people simply cannot afford that. However previously there were no forms and no guidelines to filing anything without fees with the CIS. If anyone filed a form and could not afford a fee, they had to write a letter. But the mailroom personnel at CIS either does not read or perhaps cannot read. So the form used to be returned asking us to send the check. You could go back and forth and in the mean time loose time or even status.
Even more egregious were fees paid due to CIS' mistake. For instance if the CIS in clear cut error denied your case, you had to file a motion to reopen for $585/- We even had a case once where the CIS collected a fee for a I-765 (EAD) filing for $340/- and lost the file. When we traced and send them the check, the reply was that my bank should ask for the money back. My bank, Bank of America, did not know how to. So we simply paid again and refiled.
Now the CIS is proposing a form: I-912 which will establish clear guidelines for fee waivers. Hopefully the form in its approved version will have no fee requirements for CIS' mistakes along with applications for applicants below the poverty level.
Don't just start spending the money that you were saving for the CIS fees yet though. Sometimes these forms take years to come to fruition. As for me, I will believe it when I ultimately see it.

Yes, what is this security clearance? I have applied for H1B renewal after 3 years on July 23rd (my receipt date) of 2007, and this still has not been processed and sent. I was told it has been sent for security clearance. I am here in US working without H1B visa after 7 months of my H1B visa expiry while my renewal is still pending as of today (03/07/08). Does anyone have an idea when is this going to be processed and will I ever get my work visa renewed ?

I will take this oppurtunity to thank everyone who showed the courage by joining us at Washington DC.
It was a great pleasure meeting all the people from the New England area. I finally got a chance to put a face to all the names with whom i have talked on conference calls. This was just an amazing experience and i am hoping we will get a chance to have more such experiences and we will keep on continuing our efforts till the time we get the system fixed.
Folks, the rally was a huge success. The situation room (15th, 16th, 17th) was an example of all the positive energy which was builing up for the rally.
The reception(17th) was a showcase of IV. The rally(18th) was the final bang.
But inspite of having so many people affected from the GREEN CARD delays from the New England area, we just had a few folks show up at the rally. This was really disappointing.
I am sure there must be a very good reason for that. But if you have any doubts, we will really like to talk to you and clarify your doubts.
As i always say.

Hi,
My company prepared for my PERM filing in EB2 category. They did all recruitement efforts. But at the time of filing, company annouced some lay-offs as "restructuring". Now my lawyer says, it is their policy not to file for PERM before six months of any lay -offs since some lay -offs involve same job title as my labor supposed to be filed. Since this is my lawyer's policy, My question is, is it safe to file PERM right now? What if I use different job title then the one my lawyer used before for recruitement efforts. (I understand he has to do new recruitement efforts for this ne job title, but is it safe?). What choices do I have, I do not want to delay my PERM filing. Please help...
