DUBLIN (Reuters) - Thousands of Irish citizens living unlawfully in the United States could be legalised in return for more work permits for U.S. citizens lured to Ireland by its thriving economy, an Irish minister said on Wednesday.
"There is clear evidence to support the establishment of some form of bilateral agreement between the U.S. and Irish governments," Labour Minister Tony Killeen said in a statement after he returned from a trip to New York.
Killeen said that, while 30,000 to 40,000 illegal Irish immigrants were living in the United States, two centuries of mass emigration to the United States from Ireland because of famine and unemployment was clearly now at an end.
Ireland's Trade and Employment Ministry said more than 4,300 Americans immigrated to Ireland in search of employment in 2005, compared with 1,700 Irish people moving to the United States, where more than 10 percent of the population claims Irish descent.
Killeen said a jobs fair in New York showed how appealing Ireland had become in the wake of the "Celtic Tiger" boom.
"The interest expressed by Americans to come and work in Ireland was so great that a queue more than two-and-a-half blocks long formed outside the exhibition venue," he said.
"In less than 15 years, Ireland has gone from being the sick man of Europe to one of the most dynamic economies in the developed world."
Killeen told Reuters in New York last week that Ireland would also try to lure Irish and U.S. citizens back to Ireland where the population is now back above 4 million, having slumped to a 120-year low of 2.8 million in the 1960s.

I am trying to file Labour under EB2 with Bachelors and 5+ year experience. My HR manager told me that filing this requires "all the other employees in my company with the same title should have a bachelor degree". She also concerned about having "Bachelor degree" as mandatory for future recruitements for the same title.
Please throw some light on this.
Not sure if this applies to ALL the other employees or just the ones in your group. I was in a similar situation and my HR said only my group matters. I have Bachelors with 5+ years of experience and my position also requires min 5 years. My EB-2 was approved last year.

Hi Gurus,
My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

Not getting a soft LUD is the norm. It just means your case was not an exception and you can't expect any miracles ..Yet! But Getting LUDs is not guaranteed to result in GC approval either. So please stop worrying about every little thing and enjoy your life... (Like I'm doing visiting this forum every now and then ;)

From over an year, I have been working on EAD. Recently I resigned from my job, however I am still looking for a new job. I have a few questions related with EAD:
1. Even after leaving the company, is it legal for me to stay in the country and for how long?
2. Can I look for any kind of job on EAD or there is any restrictions?
3. Is it possible that my former employer can cancel my EAD?
4. If I find a new job, do I have to use immigration lawyers of my former employer to help renew my EAD, travel document etc. from time to time or I can hire another immigration lawyer?

Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

I think You need to be out of USA for more than 1 Year which will reset your L1/H1 time accumulation.
In your case Your all L1 stay will be counted which start on arrival & stops on departure from USA.
So though your L1 approved in Mar your L1 time count starts from DEC-2008. H1/L1 times counted together but you get additional year (6th year) compared to L1. Looks you have more than 2 year on your L1.

I worked under H1B (valid 11/02/2009 - 10/14/2012) with nonstop paystubs since 11/02/2009.
On 08/02/2010, some bad girl just wrote one short sentence false statement to USCIS and cancelled/revoked my H1B on 08/09/2010 secretly since she didn't notify anybody about what she had done. She also ignored 2 USCIS letters (dated 08/13/2010 and 02/04/2011 respectively) regarding the H1B cancellation.
When I was going to join a new employer in March, I was told that my H1B was "inactive" and "retracted" by USCIS. the bad girl subsiquently filed a H1B petition with nunc pro tunc requirement for me but USCIS only approved I-797B with validation period 04/14/2011 - 10/14/2012 without I-94. I have to get H-1B visa from a US consulate.
Will I be subject to 3 years ban?! Technically I have been OOS since 08/09/2010, however, I have been paid without any gap since 08/09/2010. I have nonstop paystubs since 11/02/2009. I am still being paid. The next paystub will be available on next Friday.
Will I be subject to 3 years ban?! Can I apply for a visa back?! Can I file a criminal charge against this bad girl?!

Right now Atlanta Processing Center processing May 2008 priority date for clean cases....for audited cases July 2007...

Hi,
I've read conflicting information on whether one is eligible to receive unemployment benefits.
Specifically, i understand as a primary applicant in AOS status, one can not claim such benefits. But how about a derivative spouse, working on EAD , who lost her job? Can she claim such benefits as unemployment insurance. I've read that unemployment insurance should NOT be construed as a public charge, since its paid by the employer , when the employee is working.
So is it safe to get the basic unemployment benefits for a derivative spouse working in AOS status?

Yes, a derivative spouse can avail unemployement benefits and not jeopardize green card. Make sure she is eligible as per state laws. Each state has a different rule on who is eligible. Do some homework by calling your local unemployement office. I know of at least couple of immigration lawyers who discussed this on their newsletters. I know sheela murthy's website had that info too. Google for it and read.....

Iam in a similar situation as Ihitha. Iam planning to go to Chennai in June for stamping. Which answer do you think would be a convincing one for that question asked by the VO ?
Also after changing from L1 to H1, i had my H1 transferred between 3 companies (i changed jobs within a span of 1 month), and the current employer iam working for, iam working for about 1 year and 3 months. When i go for stamping, would they be asking for paystubs from those two companies, or does it matter only with the latest company iam working for ?
